Official Rules for Papyrus® Giveaway
No Purchase Necessary to Enter or Win the Papyrus Giveaway (each, a “Giveaway”). A Purchase Will Not Increase Your Chances of Winning. Void where prohibited by law and outside of the United States (U.S.).
Sponsor: The Giveaway is sponsored by Papyrus-Recycled Greetings, Inc., One American Boulevard, Cleveland, Ohio 44145 (“Sponsor”).
Eligibility: The Giveaway is open only to legal residents of the 50 U.S. and the District of Columbia who are at the time of the Giveaway 18+ (19+ in AL and NE; 21+ in MS) years old (the “Entrant”). Employees of Sponsor, its subsidiaries and affiliates, as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, its advertising and promotion agencies, and suppliers are not eligible to enter. Winning a prize is contingent upon Entrant fulfilling all requirements. Sponsor reserves the right to verify eligibility.
Agreement to Official Rules: Giveaways subject to these Official Rules will be posted using Sponsor’s Instagram handle @papyrus. Participation in the Giveaway constitutes an Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in connection with the Giveaway. All federal and state laws apply.
How to Enter: The Giveaway must be entered by submitting an entry that fulfills the requirements identified on Sponsor’s Instagram post touting the Giveaway (the “Social Giveaway Post”). For example, to enter, Entrants simply: (i) follow (if not already following) @papyrus; (ii) like the Social Giveaway Post; and (iii) tag another Instagram account in a comment. Each Social Giveaway Post will provide the specific dates and times for Entrants to enter the Giveaway (the “Entry Period”). Entries submitted before or after the applicable Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Giveaway. There is a limit of 1 entry per person. Additional entries will be disqualified. Automated or bulk entries submitted by third parties will also be disqualified.
Winner Selection and Notification: Sponsor will select the name of 2 potential winners in a random drawing of all valid entries received during the Entry Period. The odds of being selected depend on the number of eligible entries received. The potential winner will be notified via direct message and must be following Sponsor’s Instagram account at the time of notice. The potential winner will required to respond to the notice and claim prize within 72 hours. If a potential winner doesn’t respond within this time, Sponsor may select an alternate potential winner. Sponsor will have no liability for a potential winner’s failure to receive notice due to spam, junk email, or other security setting or potential winner’s provision of incorrect or non-working contact information.
Potential Winner Requirements: Except where legally prohibited, the potential winner may be asked to complete and return a Declaration of Eligibility and Liability & Publicity Release within 5 days of being notified. If a potential winner fails to timely respond to the notification or to sign and return the required documents or is otherwise disqualified, they will forfeit the prize, and Sponsor may select an alternate potential winner in a random drawing of all remaining entries received. Only 3 alternate potential winners will be contacted, if time permits, after which any remaining prizes will remain un-awarded.
Prizes: Total prize value: approximately $150. Actual/appraised value may differ at the time prize is awarded. Prizes for the Giveaway will be posted by Sponsor and consist of only those items specifically listed as part of the prize in the Social Giveaway Post. Limit one prize per family or household. No cash or other prize substitution or transfer of prize is permitted by winner. Sponsor reserves the right to substitute a prize of equal or greater value. Winner is responsible for paying any applicable income taxes and any and all other prize-related costs and expenses. Any prize details not specified here or in the Social Giveaway Post will be determined by Sponsor in its sole discretion.
General Conditions: In the event that the operation, fairness, security, or proper administration of the Giveaway is impaired in any way, Sponsor may, in its sole discretion, either: (a) cancel or terminate the Giveaway; (b) modify or suspend the Giveaway to address the impairment; or (c) award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages to the fullest extent of the law, from any individual who tampers with the entry process or operation of the Giveaway, violates these Official Rules, or acts in a disruptive or unethical manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication. By entering Giveaway, Entrant agrees to receive email newsletters periodically from Sponsor. To opt-out of receiving this communication at any time click on the unsubscribe link in the newsletter.
Release and Limitations of Liability: By entering, Entrant agree to release the Sponsor, Instagram, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (collectively, the “Released Parties”) from any claim or cause of action that may occur, directly or indirectly, whether caused by negligence or not, from Entrant’s participation in the Giveaway or receipt, use or misuse of any prize, including, but not limited to: (a) unauthorized human intervention in any part of the Giveaway; (b) technical failure or network errors of any kind, including system, application, or software malfunction; (c) posting or printing errors; (d) lost, late, postage-due, misdirected, or otherwise undeliverable mail, email, or messaging; (e) errors in the administration of the Giveaway; or (f) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorneys’ fees or other legal costs. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Privacy and Publicity: Any information submitted as part of the Giveaway will used in accordance with Sponsor’s Privacy Policy. If you are a California resident, please refer specifically to Sponsor’s California Privacy Notice for additional information under applicable California privacy laws concerning collection of your information for the Giveaway. Except where prohibited by law, Winner grants to Sponsor, its subsidiaries and affiliates, retailers, agencies, and suppliers, the right and permission to use, publish, print, post, or broadcast, the Winner’s name, likeness, voice, opinions, biographical information, social handle, and state of residence for promotional, advertising, trade, or compliance purposes in any media without additional payment, consideration, permission, or notification.
Disputes and Governing Law: Entrants agree that any disputes, claims, or causes of action arising out of, or connected with, the Giveaway shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Ohio. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, Entrant or Winner rights and obligations, or the rights and obligations of Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of Ohio, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Ohio.
Winner Information: The Winner’s name (or social media handle) will be published by Sponsor after the end of the Giveaway or may be provided upon written request to Sponsor.
This Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram. Entrant understands that the information provided is to Sponsor and not to Instagram.
